Terms of Use

These Terms of Use ("Terms") form an agreement between you and GardenGenius governing your use of the GardenGenius mobile application. By downloading, creating an account, or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use GardenGenius. By using the app you confirm that you meet this requirement and can form a binding agreement.

2. Your account

GardenGenius may start in an anonymous session and lets you create or link an account using Sign in with Apple or Google. You are responsible for activity that occurs under your account and for keeping your sign-in method secure.

3. Community guidelines & user content

GardenGenius includes community features where you can post text, photos, and comments ("User Content"). You retain ownership of your User Content, and you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the app to operate these features.

There is zero tolerance for objectionable content or abusive behavior. You agree not to post or do any of the following:

• Content that is unlawful, hateful, harassing, threatening, or discriminatory.
• Sexually explicit, violent, or otherwise objectionable content.
• Spam, scams, malware, or infringement of others' intellectual property.
• Impersonation, doxxing, or sharing others' private information.

We moderate User Content. You can report objectionable content and block abusive users from within the app. We aim to review reports and remove violating content within 24 hours and may suspend or remove accounts that violate these guidelines. We may remove any content or terminate access at our discretion to keep the community safe.

5. Subscriptions & payments

GardenGenius offers premium features through auto-renewing subscriptions. The following terms apply:

• The subscription title, length, and price are shown in the app before you purchase.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

Purchases are also governed by Apple's standard Apple Media Services / Licensed Application End User License Agreement (EULA), which is incorporated into these Terms by reference.

6. Acceptable use

You agree not to misuse the app: no reverse engineering, no attempting to breach security, no automated scraping, and no using the app to violate any law or third-party right.

7. Intellectual property

The GardenGenius app, including its design, software, and content (excluding your User Content), is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes, subject to these Terms.

8. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that any result (including AI output) is accurate.

9. Limitation of liability

To the maximum extent permitted by law, GardenGenius is not liable for any indirect, incidental, or consequential damages, or for any loss arising from your reliance on AI results, plant outcomes, or community content.

10. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the app after changes means you accept the updated Terms.
